I am in Texas. I got a buyer for my Bersa Series 95 380. How do I (an individual, not a dealer) legally sell the gun to another individual? She bought 2 other guns during the "Black Friday" sale at Academy, one for her, one for her husband. She plans on giving the 380 to her daughter who lives alone. I am saying this because if she bought 2 guns, she MUST'VE passed the background requirements. Are there forms we can fill out and get notarized? As soon as this transaction is done, I plan to purchase a 24/7 Pro DS 40 (or 45, still deciding)

You are only gonna be in trouble if you know the buyer is a 'prohibited person' ( felon, under age, psycho, etc )
my buddy from austin says its just like here in idaho, you hand them the gun they hand you the cash or trade. no bill of sale requied,. only way to get into trouble is if you know they are a felon or under 18

Thanks for the info. Since there is no paperwork that the law requires, is there something else I can do? Here is what I am concerned about: Gun gets stolen from the person I sell it to. It is used in the commission of a crime. Gun is found by law enforcement and traced back to me, the original owner. I go to jail some kind of way and rot there until I can go infront of a judge. No income comes in because I am self employed and now in jail. We lose the house. Wife takes the kids, divorces me, and moves to "YOU WILL NOT FIND ME", USA. I love my wife and kids. So, given that scenario, is there something else I can do?

All you have to do is say you sold the gun to a private party and it is no longer in your possession. That's the way it works in Arizona.
If you feel that uncomfortable, make a "bill of sale" and have the person purchasing your firearm sign and date it. You could also get a copy of their drivers license if they'd be willing.
same thing in idaho just say you sold it and no longer own it, even though its not required i do a bill fo sale for m every time i sell a gun i get their name off their drivers license D.O.B. and have them sign it and date it.

If "agents" come to your door looking for your listed ,legally possessed, stuff it might not be a bad idea to have saved ads from shotgun news or your local paper where you "sold" all of your guns.
Cheap insurance
Here in Arkansas, you can sell any of your gun without paperwork. But when I sell one I make out a bill of sale just for a little extra CMA, (cover my @$$) even though it's not really needed.
