From the wording of the story it sounds as if the CCW holder initiated the Gunfight, I hope that isn't the case, He may be on the hook for a lot more than the Store lost in the robbery.
Then again, how else would you have expected the story to have been worded? Armed gunman are a "fact of life", but a CCW holder defending himself against armed gunmen? Well, that's just not right.
I'm afraid Lil Beaver's right. Someone will surely sue the CHL holder, and he will wish he hadn't orta done that.

If the robbers were actively shooting He was defending Himself, if He fired the first shot He'll be held responsible.
If they were robbing Him it would be different, but they were robbing the store and He was a bystander.
The store can write off their losses on their taxes, no reason to start a Gunfight.

We have had that discussion here before and is was always in the hypothetical. Here is a real life example. I feel very badly for the clerk who lost her life and her family. If the first shot was fired by the CCW holder he most likely will be in a world of hurt, perhaps criminally and for damages to the lady's family. We will of course have to wait and see what the investigation reveals.

Gee, then I guess that Crimson Trace ad that shows the by-stander challenging the shot-gun equipped robber in a convenience store should be edited then? Where do some of these "explanations" come from? We take an article by a newspaper, and pontificate about "if", or "he should", and arrive at the most inane conclusions.
Let's just wait and see what actually happened before declaring somebody wrong, or eligible for a trip to the Gray-bar Motel.

A Crimson Trace ad is purely a work of fiction and should be viewed as such, not even a trained professional is going to initiate a Gun battle against 2 armed robbers with innocent bystanders around.
What We do know is that one Family will never see their Wife/Mother/Daughter again because somebody tried to be a Hero.
The Store is part of a large chain and will make their money back on the first day back in business so there was no need to endanger anyone else.
And I would not be surprised if it turns out that "Joe Cool" fired the fatal shot.
